1.2 Apogeo Space S.r.l. with registered office in  Via Malta 7/C, 25124 Brescia (BS), Tax Code, VAT Number 03524570987 and registration number in the Register of Companies of Brescia BS-541600 (hereinafter “Apogeo”, “we”, or “our”, as the case may be) will act as “Data Controller” of the processing of your personal data, for the purposes better specified in art. 3.

2. Information we collect

2.1 We collect personal data that includes information that can be used to identify you, including, but not limited to, your first and last name, address, zip code, city, country, telephone number and email address (hereinafter referred to as “Personal Data”).

2.2 You may be required to provide to us your Personal Data by filling in the forms published on/our/websites, and/or when you ask us to contact you, and/or during certain events, for the purposes described in art. 3. The Personal Data you provide to us may include your name, date and place of birth, email address and any other information you provide when you interact with us or contact us.

2.3 We may collect your name, contact details, email address, home address and any other information you provide by interacting with us, by requesting information through our website, by submitting a tyre registration form, or when you contact us.

3. Use of personal data

3.1 We will use your Personal Data for the following purposes:

I. for your registration on/to our website/Internet;

II. to respond to your requests for assistance;

The processing of your Personal Data, for the purposes of this art. 3, it is necessary to fulfill your request and therefore does not require your prior consent.

3.2 Apogeo may also use your Personal Data for marketing purposes, as described in art. 7 below, with your prior consent.

3.3 The provision of your Personal Data is voluntary but necessary for the purposes referred to in this art. 3; if you do not provide your Personal Data, it will be impossible for us to carry out such activities.

4. Personal data Sharing

4.1 We may share your Personal Data, if permitted by law or as follows:

(a) Apogeo Group company. Your Personal Data may be shared with any group company for the pursuit of legitimate interests related to the performance of organizational and technical activities related to the purposes referred to in art. 3.

(b) Third Parties. If your Personal Data is provided for the purposes of participating in activities, events, initiatives or competitions, your Personal Data may also be processed by service providers and/or insurance companies appointed by Apogeo. These third parties are subject to confidentiality restrictions with us and other legal restrictions prohibiting the use of the information we provide to them for purposes other than the related outsourcing activity, unless it has been expressly agreed or your permission has been granted for additional purposes. These third parties will act, unless otherwise specified, as data processors.

(c) As permitted or required by law. In some cases, we may be required to provide Personal Data in response to a court order, subpoena, government investigation, or as otherwise required by law. We also reserve the right to disclose to the relevant authorities all activities that, in good faith, we consider illegal or in violation of applicable laws. 6. Personal data storage

6.1 We will retain your Personal Data (i) until your account is active (if applicable); (ii) for a period of 1 (one) year from our last communication, if you have only requested information and/or assistance; (iii) for the period required by applicable European legislation in relation to Personal Data collected for the purpose of specific activities, events, initiatives or competitions; (iv) for marketing purposes, for a period of 2 (two) years from the last communication of Apogee, unless you request otherwise. In addition, we will retain your Personal Data, if necessary, to fulfill our legal obligations, resolve disputes and enforce our rights (for defensive purposes). We will delete your Personal Data at your request, where applicable, in accordance with applicable data protection regulations.

7. Electronic format commercial communications

7.1 Based on your specific consent to marketing activities, Apogeo S.r.l. will authorize you to send you promotional emails (including newsletters) and other electronic commercial communications related to products and/or services of Apogeo or other companies of the Apogeo group and/or products and services. You can at any time limit the communications that Apogee sends you. To not receive commercial emails in the future, just click on the link “Unsubscribe” or “unsubscribe” at the bottom of every email that Apogeo sends.

8. Where we store your personal data

8.1 Apogeo will store your Personal Data in its information systems located within the European Union.

9. Third parties privacy policy

9.1 This Privacy Policy concerns only the use and disclosure of information by Apogeo. We are not responsible for the privacy policies of other websites or applications and we encourage you to read all the terms, conditions and privacy policies provided by third parties before providing them with your information.

10. Minors of age personal data limitation

10.1 If you are a minor of age, do not provide us with any Personal Data without the consent of the person exercising parental authority over you. If we become aware that we have collected Personal Data from a underage, without the consent of the person exercising parental authority over him/her, we will promptly delete such information. 11.1 We use security measures to protect your Personal Data from unauthorized access, improper use or disclosure, unauthorized modification, illegal destruction or accidental loss.
